Welcome to Stewart Thomson Media! We are thrilled to offer our professional photography, videography and social media services. By engaging with our services, these are the terms and conditions:
1. Service Agreement
1.1. The client agrees to engage Stewart Thomson Media for the provision of photography and videography services as specified in the agreed-upon package or contract.
1.2. Any changes or modifications to the agreed-upon services must be agreed upon by both parties.
2. Bookings and Reservations
All bookings are subject to availability and will be confirmed upon a week in advance when possible.
3. Cancellation and Postponement
3.1. If the client needs to cancel or postpone a scheduled event, they must notify Stewart Thomson Media in writing as soon as possible.
3.2. If Stewart Thomson Media is unable to fulfil the agreed-upon services due to unforeseen circumstances, every effort will be made to provide a suitable replacement. If a replacement is not available, all deposits and fees will be fully refunded.
4. Payment
4.1. The client agrees to pay the total agreed-upon fee for the services provided by Stewart Thomson Media.
4.2. Payment terms will be detailed in writing before the day of the event. Payment is typically due in full before or on the day of the event, unless otherwise agreed upon.
5. Image and Video Usage
5.1. Stewart Thomson Media retains full copyright and ownership of all images and videos taken during the event or session.
5.2. The client is granted a non-exclusive, non-transferable license to use the edited and delivered images and videos for personal and commercial use.
5.3 Stewart Thomson Media reserves the right to use any photos or videos for their own marketing purposes including sharing on social media and their website unless otherwise agreed upon by both parties.
6. Image and Video Editing
6.1. Stewart Thomson Media will edit and retouch images and videos to its professional standards.
6.2. Requests for additional edits, alterations and revisions beyond the standard editing may be subject to additional fees.
7. Revisions
7.1 A revision refers to a list of clear and easy to understand comments with each comment assigned to a specific time in the video. For example: "At minute 1:24, please change the colour of the title to blue".
7.2 Revisions do not include change of music, change of soundtrack, change of video concept, change of script and shooting the footage from scratch.
7.3 Free Revisions: 2 revision sets are included for each piece of video content.
7.4 Additional Revisions: Additional revisions can be accommodated at a cost of £100 per revision.
8. Client Cooperation
8.1. The client agrees to cooperate with Stewart Thomson Media and provide necessary information to ensure the successful provision of services.
8.2. Stewart Thomson Media is not liable for the quality of images or videos compromised due to the client’s failure to cooperate or provide essential information.
9. Liability and Indemnity
9.1. Stewart Thomson Media will take reasonable care to deliver high-quality services, but is not liable for any unforeseen circumstances or events beyond its control.
9.2. The client agrees to indemnify and hold Stewart Thomson Media harmless from any liability, claims, damages, or expenses arising out of or related to the client’s use of the images and videos.
10. Confidentiality
Stewart Thomson Media will treat all client information as confidential and will not share or disclose any personal or sensitive information to third parties without explicit consent, except as required by law.
11. Governing Law and Jurisdiction
11.1. These terms and conditions shall be governed by and construed in accordance with the laws of Northern Ireland.
11.2. Any disputes arising from these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Northern Ireland. By engaging with Stewart Thomson Media’s services, you acknowledge that you have read, understood, and agree to abide by these terms and conditions.
